These Terms of Use ("Terms") govern access to and use of SimpleVote operated by SIMPLEVOTE LTD (Company No. 17251484), registered in England and Wales. By creating an account or using the service, you agree to these Terms.
1. The service
SimpleVote provides software for running Scottish STV and related organisational elections using anonymous voting by personal email link (no voter accounts), multi-ballot elections, and published results.
2. Your responsibilities as an organiser
- You are responsible for the lawfulness of voter lists you upload, including having appropriate consent or other lawful basis to contact each person.
- You must provide accurate election configuration, communicate closing times to voters, and follow your organisation's governance rules.
- You must not use SimpleVote for unlawful, fraudulent, or abusive purposes.
- You must keep your login credentials confidential.
3. Voter data and the DPA
Where you upload voter contact details, you act as data controller and SimpleVote acts as data processor. You must accept our Data Processing Agreement before sending voter invites.
4. Service limits
Usage may be subject to tier limits described on the Pricing page. We may suspend or restrict access for security reasons, tier breaches, or violation of these Terms.
5. Availability and changes
We aim for reliable service but do not guarantee uninterrupted availability. We may modify features with reasonable notice where practicable.
6. Intellectual property
SimpleVote software, branding, and documentation remain our property. Election content you upload remains yours; you grant us a licence to host and process it to provide the service.
7. Liability
To the fullest extent permitted by law, SimpleVote is provided "as is". We are not liable for indirect or consequential losses. Our total liability for any claim relating to the service is limited to the fees paid by your organisation in the twelve months before the claim (or £100 if no fees were paid), except where liability cannot be limited by law.
8. Termination
You may delete your account at any time from Account settings. We may terminate or suspend accounts that breach these Terms. Election records required for audit integrity may be anonymised rather than destroyed.
9. Governing law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
